05-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Kadwa P.S. Case No. 262 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. There is case and counter case between the parties. Petitioner is alleged to have given farsa blow on the head of Md. Rashid.

It is submitted on behalf of petitioner that injury, caused by petitioner, has been found to be simple in nature. There is land dispute between the parties and one title suit, vide Title Suit No. 68 of 2019, is already pending before the court of learned Sub-Judge, Barsoi. Petitioner is having no criminal antecedent.

Considering the aforesaid facts and circumstances as

No.13322 of 2020(2) dt.05-03-2020 2/2 well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No. 262 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
