JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 27-08-2021 Learned counsel for the petitioner undertakes to remove all the defects pointed out by the Stamp Reporter within four weeks after start of normal functioning of the Court. Heard learned counsel for the petitioner and Mr. Arun Kumar Singh No. 5, learned APP for the State. The petitioner in the present case is seeking regular bail in connection with Laxmipur P.S. Case No. 21 of 2020 registered for the offences punishable under Sections 395, 397, 412 of the Indian Penal Code and Section 25(1-b)a, 26, 27, 35 of the Arms Act. He is in custody since 17.01.2020. He has got one criminal antecedent but the said case has been lodged after filing of the present case and hence the same is not mentioned in paragraph '3' of the application. His prayer for bail is pending in the said case.

Patna High Court CR. MISC. No.23384 of 2021(2) dt.27-08-2021 2/3 Learned counsel submits that so far as the present case is concerned, he was not arrested on the spot, his name has transpired in the confessional statement of the co-accused Sachin Kumar Singh. From possession of the petitioner one country-made pistol, two live cartridges and Rs.17,000/- in cash has been allegedly recovered. The co-accused Sachin Kumar Singh has been granted bail by a learned Co-ordinate Bench of this Court in Cri. Misc. No. 24796 of 2020.

It is further submitted that two seizure list witnesses are police personnel.

Learned APP for the State has opposed the prayer for bail of the petitioner but considering the facts and circumstances of the case wherein the co-accused was arrested on the spot has been granted bail and the petitioner is in custody for more than one and half year, investigation against him is complete, this Court directs release of the petitioner above named on bail on furnishing of bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jamui in connection with Laxmipur P.S. Case No. 21 of 2020. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage

No.23384 of 2021(2) dt.27-08-2021 3/3 it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification. The application stands allowed.
