The petitioner is apprehending his arrest in a case registered under Sections 420, 467, 468, 471, 472, 504, 506 of the Indian Penal Code.

Allegation is that the petitioner took Rs.2,50,000/- from the informant on pretext to sell Scorpio vehicle within fifteen days but he did not hand over the same and on demand of money, he gave a cheque of Rs.1 lac to the informant, which was bounced by the Bank due to insufficient fund.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The

Patna High Court CR. MISC. No.13138 of 2019(2) dt.06-03-2019 2/2 alleged occurrence is said to have taken place on 05.11.2014 and the case has been instituted on 10.01.2018. The delay has not been explained by the prosecution. There is money transction between the two parties. The matter relates to civil dispute. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. case No.8 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
