JUSTICE ARUN KUMAR ORAL ORDER 18-04-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 25.11.2017, seeks bail in Rajpur PS Case No. 288 of 2017 registered under Sections 302, 201/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that the informant's brother stayed in the house of the petitioner thereafter he was found missing and later on his dead body was found near bank of a river. Learned Counsel for the petitioner submits that only suspicion is raised against the petitioner, there is no eye witness as also no motive against the petitioner for killing the deceased and further submits that similarly situated another co-accused, brother of the petitioner, has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No. 6980 of 2018, moreover the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Dular Chouhan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM VIIth Buxar in connection with Rajpur PS Case No. 288 of 2017.
