1. Heard learned counsel for the petitioner as well as learned APP for the State.
2. The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)(a), 26/35 of the Arms Act.
3. The learned counsel for the petitioner submits that petitioner has antecedent of five cases and has been falsely implicated in the instant case by the informant.
4. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no arms or cartridges were recovered from his possession. It is next submitted petitioner is in custody since 31.10.2023 and in the event if he is granted bail he will cooperate in the trial.
5. The learned APP opposes the regular bail
Patna High Court CR. MISC. No.16254 of 2024(3) dt.20-04-2024 2/2 application, but then is not in a position to rebut the submission of the learned counsel for the petitioner that no arms or cartridges were recovered from his possession.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Giriyak (Pawapuri) P.S. Case No.201 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C. with a further condition that one of the bailor of the petitioner shall be his father, namely, Gore Lal Singh @ Sunil Singh.
7. The application stands allowed.
8. However, in the event if the learned trial court comes to a conclusion that petitioner after his release on bail is trying to delay the trial in any manner, in that event, the trial court would be at liberty to cancel the bail bonds of the petitioner.
