The petitioners are in custody in connection with Mirganj P.S. Case No. 113 of 2017 for the offences under Sections 419, 414 and 120(B)/34 of the Indian Penal Code. The petitioners are in custody since 2.5.2017. There is statement on affidavit in para-3 of the petition that the petitioners have no criminal antecedent. The petitioners were arrested with Apache motorcycle bearing registration No. BR-29F/2086. It is submitted on behalf of the petitioner that the motorcycle was given to them by one Mukesh Kumar Sharma and

From perusal of the case diary, it appears that the petitioners were arrested by the police on failure to produce valid document regarding ownership of the motorcycle. Having regard to the fact that the petitioners are in custody since 2.5.2017 and as per the statement in para-3 of the petition on affidavit that they have no criminal antecedent, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM-XVI, Gopalganj or the successor Court in connection with Mirganj P.S. Case No. 113 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence and influence the witnesses.
