====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 01-05-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Madhubani Town P.S. Case No. 209 of 2022 registered for the offence under Sections 413 and 414 of the I.P.C. The prosecution case, in brief, is that on information, the informant apprehended the petitioner and two motorcycles and other articles were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.06.2022. He has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner.

Two Motorcycles and other article are said to have been recovered from his possesson and from the house of the petitioner. It is further submitted that the petitioner had purchased the said Motorcycles. He had no knowledge regarding the stolen Motorcycles in question. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VIII, Madhubani, in connection with Madhubani Town P.S. Case No. 209 of 2022.
