The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that there is no recovery from the possession of the petitioner, however, on the basis of statement made by co-accused he has been named in the First Information Report for recovery of 225 bottles of foreign liquor in a tempo. Petitioner claims that he is having clean antecedent and is in custody since 23.05.2017.

No.36431 of 2017(2) dt.10-08-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Sugauli P.S. Case No. 04 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
