Petitioner is in custody since 24.08.2016 in connection with S.T. No. 391 of 2016 arising out of Khagaria (Gangaur) P.S. Case No. 508 of 2016 registered under Sections 302 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the prayer for bail of this petitioner has been refused by this Court vide Cr. Misc. No.47576 of 2016 with an observation that prayer for bail of this petitioner may be considered after framing of charge. Now, charges have been framed in this case, which is evident from annexure-3 to this application. The petitioner is still rotting in custody for the last 10 months.
