Petitioner seeks bail in a case registered for the offences punishable under Sections 406 and 409/34 of the Indian Penal Code.

Submission is that the petitioner was Headmaster of the school where construction of building was going on. When the construction was on half way, the petitioner was transferred. Allegation is that he misappropriated the remaining amount. Submission is that after lodging of the FIR, petitioner has already completed the construction which would be evident from the certificate granted vide Annexure-2. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.7859 of 2018 (2) dt.09-02-2018 2/2 Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhargama Police Station Case No. 152 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
