The petitioner seeks bail in anticipation of his arrest in connection with Bajpatti P.S. Case No. 436 of 2020 instituted for the offences under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

The accusation against the petitioner is of having assaulted Deepak Kumar, his cousin on his head by means of an iron rod. The injury suffered by aforesaid Deepak Kumar is stated to be simple in nature. The dispute arose out of a very small incident of tying the cattle at a particular place. It has been submitted on behalf of the petitioner that since the informant and father of the petitioner are own brothers, they have taken a conscious decision not to continue with this

Considering the afore-noted cats, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Bajpatti P.S. Case No. 436 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
