The petitioner is languishing in custody for the offences punishable under Sections 363, 364 of the I.P.C. The FIR was lodged after missing of the second wife of the petitioner since 07.02.2018. Allegation is that for nonfulfillment of demand of the petitioner of rupees two lacs the victim got kidnapped and missing.

Submission is that in the past prayer for bail was refused vide order at Annexure-1 with liberty to petitioner to renew the prayer for bail after framing of the charges. Charges have already been framed. In fact, the victim left the house of the petitioner at her own and thereafter, she is traceless.

No.25331 of 2021(2) dt.15-09-2021 2/2 Considering the submission aforesaid, let the petitioner, above named, who is in custody since 25.11.2019, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Balrampur P.S. Case No. 22 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
