JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2016 Petitioners being parents-in-law of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 323, 341, 420, 468, 471, 376, 386, 498A, 120B/34 of the Indian Penal Code. The prosecution case is that the informant was married with Murari Tiwari, son of the petitioners who was mentally abraised. Subsequently other son of the petitioners namely Alakh Niranjan Tiwari @ Sonu ravished the informant and thereafter continued establishing physical relationship leading to birth of a female child but thereafter the accused persons made an attempt to kill the newly born baby. It is submitted by learned counsel for the petitioners that thrust of accusation is against Alakh Niranjan Tiwari @ Sonu and there is omnibus and general accusation against the petitioners.

No.14324 of 2016 (2) dt.01-04-2016 P2/2 Considering the fact that thrust of accusation is against Alakh Niranjan Tiwari @ Sonu, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Sangrampur P.S. Case No. 110 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
