The petitioner seeks regular bail in connection with Rajauli PS case no. 7 of 2019 registered for the offence punishable under Section 420, 120B/34 of Indian Penal Code and 30(A), 41 of Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of huge quantity of liquor from a truck, whereupon the driver and the assistant driver were arrested. As far as the petitioner herein is concerned, it has been alleged that he used to provide mobile sim to the other accused persons for the purposes of operating illicit liquor business.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case

Patna High Court CR. MISC. No.15295 of 2019(2) dt.12-03-2019 2/2 and he is having clean antecedent. It is further submitted that the petitioner has got no role to play in the alleged incident which is apparent from the F.I.R. The petitioner is said to be languishing in custody since 19.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District JudgeII-cum-Special Judge, Nawada in connection with Rajauli PS case no. 7 of 2019.
