JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-03-2017 The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 341, 323, 354, 308 and 504/34 of the IPC.

It is alleged against the petitioner Sakil Ahmad that he dragged the informant and when the sister in law of the informant namely Kaitun Nissa came to rescue then he caused injury to her with Dabila.

Earlier anticipatory bail application of the petitioner was disposed of vide Cr. Misc. No. 3886 of 2016 since the opinion with regard to one injury caused by the petitioner was kept reserved.

It is submitted by the learned counsel for the petitioner that now the injury report has come and injury has been

It is further submitted that though under wrong instruction, in the earlier application for anticipatory bail it was wrongly mentioned that the petitioner has no criminal antecedent but the petitioner is accused in two other cases also apart from present one being Yogappti P.S. Case No. 157 of 2007 and Complaint Case No. 847C of 2007. Though, this Court is not inclined to revise the earlier order but keeping in view of the nature of accusation and the injury found to be superficial simple in nature, it is a case for consideration of bail if the petitioner surrenders within a period of six weeks in connection with Bairiya P.S. Case No. 263 of 2015 pending in the court of learned CJM, Bettiah, West Champaran. Accordingly, the present application is disposed of. (Dinesh Kumar Singh, J) Amrendra/- U T
