Petitioner, already in custody, seeks bail in connection with Gopalpur (Rangra) P.S. Case No. 18/2016, registered under Sections 147, 148, 307, 379, and 504 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that one Hulwa Mandal shot causing injury to she bufallow and Bhagta Mandal shot at the informant and rest were identified by the informant. Learned counsel for the petitioner submits that there is no specific overt act alleged against the petitioner and Bhagta Mandal who is said to have fired at the informant has been admitted to bail by a co-ordinate Bench of this Court vide Cr.
Patna High Court Cr.Misc. No.21828 of 2018(2) dt.13-04-2018 2/2 Misc. No. 35971 of 2017 and the petitioner has remained in custody for one year.
Having considered the aforesaid facts and circumstances, petitioner Kheshra Mandal @ Khesar Mandal @ Nand Kishore Mandal is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to this satisfaction of learned Additional District and Sessions Judge-I, Naugachia, Bhagalpur in connection with Gopalpur (Rangra) P.S.
