Petitioner apprehends arrest in a case registered for the offences punishable under Section 381 of the Indian Penal Code.
Prosecution case in brief is that 600 bags of rice was stolen from the Godown by informant's driver Pintu Kumar in connivance with other accused persons.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. His name has come in this case on the confessional statement of coaccused Pintu Kumar. Nothing incriminating has been recovered from the possession of the petitioner to connect him with the instant occurrence.
Considering the facts of the case, let the petitioner,
Patna High Court CR. MISC. No.15092 of 2020(2) dt.07-07-2020 2/2 above named, in the event of surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge cum Additional Chief Judicial Magistrate, Patna in Jakkanpur Police Station Case No. 812 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
