JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This is an application for grant of anticipatory bail in connection with Nardiganj P.S. Case No. 25 of 2018, disclosing offences under Sections 144, 147, 148, 341, 323, 325, 307, 379 and 420 of the Indian Penal code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is that they have assaulted the informant while he was coming along with his uncle from Nawada and there is specific allegation of firing against the petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case due to previous enmity.

Heard learned A.P.P. also, who opposed the prayer of anticipatory bail to the petitioner.

No.15832 of 2019(3) dt.02-05-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record, specially the nature of injuries.

With the above observations, this application is disposed of.
