The petitioner apprehends his arrest in Begusarai Town P.S. Case No. 207/2005, registered for the offence punishable under Sections 409, 420, 467, 468 of the Indian Penal Code. The petitioner was entrusted with two cheques bearing no. 419673 of Rs. 2,00,000/- and no. 419675 of Rs. 1,05,000/-, but the petitioner credited both the cheques in the account of Nirmal Kumar and Sri Arun Deo Prasad Singh and withdrew the amount. It is submitted that due to bona fide mistake of the petitioner the account of different persons were credited and when the bank official came to know about the mistake he informed the account holders. Patna High Court Cr.Misc. No.15052 of 2016 (3) dt.30-06-2016 2/2 account of bona fide mistake the cheques were credited in the accounts of different person. Departmental proceeding was initiated and minor punishment was awarded to the petitioner for his negligence.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 207/2005, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
