JUSTICE BIRENDRA KUMAR ORAL ORDER 09-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 341/323/354 of the Indian Penal Code and Section 8 of the POCSO Act.

The petitioner is in custody since 02.11.2017. Allegation against the petitioner is that he attempted to ravish the informant, a minor girl, while she was cutting grass. Submission is that in fact some quarrel had taken place as the girl was cutting the green crops of the petitioner and just to pressurize the false case has been lodged. Investigation of the case is already complete and petitioner is ready to cooperate with the trial.

Patna High Court Cr.Misc. No.19220 of 2018 (2) dt.09-04-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Daudnagar P.S. Case No.304 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
