The petitioner seeks regular bail in connection with Bisfi (Patauna) P.S. Case No. 24 of 2008 registered for the offences punishable under sections 302, 201 and 34 of the IPC. Earlier the prayer for regular bail was rejected twice vide order dated 26.11.2012 passed in Cr. Misc. Case No. 34638 of 2012 and later on vide order dated 03.12.2014 passed in Cr. Misc. Case No. 39138 of 2014 by the coordinate bench of this Court with a direction to the trial court to expedite the trial as soon as possible but till now trial has not been concluded. Heard learned APP, also, opposes the prayer.
Having heard both sides, in view of the facts and
Patna High Court Cr.Misc. No.31163 of 2017 (4) dt.02-08-2017 2/2 circumstances, I am not inclined to enlarge the petitioner on bail and accordingly his prayer stands rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of six months and at the same time the District Magistrate of Madhubani is directed to ensure the presence of investigating officer and doctor in the court on the date fixed so that the trial can be concluded with the said period.
With the above observation, this application is dismissed.
