JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-04-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

This is an application for grant of anticipatory bail in connection with Araria P.S. Case No. 430 of 2017 for the offence registered under Sections 341, 323, 332, 353, 186, 504 and 506 of the Indian Penal Code.

The allegation in the present case is regarding the petitioner and one another engaging in altercation with the police personnel and as far as the petitioner herein is concerned, he is said to have abused the police personnel.

The learned counsel for the petitioner submits that there is no allegation of any over act and the petitioner is ready to abide by whatever terms and conditions this Court may impose. Having regard to the facts and circumstances of the

No.9308 of 2018 (3) dt.06-04-2018 2/2 case, It is directed that the petitioner shall deposit a sum of Rs. 2500/- with the Nazarat of the concerned court within a period of four weeks from today and shall surrender before the concerned court within the same time frame whereafter he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria in connection with Araria P.S. Case No. 430 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

It is needless to say that the deposit of the aforesaid amount of Rs. 2500/- shall be subject to the final outcome of the case.
