JUSTICE RAVI RANJAN ORAL ORDER 28-01-2015 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in connection with a case registered for the offences under Sections 352, 307/34, 504 of the Indian Penal Code.

The anticipatory bail has already been granted to the petitioner no.1 Ranju Devi vide order dated 2.8.2014. It has further been stated in the aforesaid order that the case of the petitioner no.2 for grant of anticipatory bail shall be considered after receipt of the case diary. Case diary has been received. Injury report has been kept at flag A & B.

Injury report shows that the injury upon the head is simple in nature and scalp deep caused by hard and blunt substance.

Patna High Court Cr.Misc. No.21978 of 2014 (4) dt.28-01-2015 Learned counsel for the petitioners submits that as per the allegation set out in the first information report, the petitioner no.2 has assaulted the informant by "Kudal" but there is no cut injury rather injury is by hard and blunt substance and is only simple in nature. It is contended that the petitioner no.2 and the informant are full brothers and it appears that altercation took place in spur of moment due to some petty dispute. Learned counsel further submits that petitioner no.2 has not been taken in custody as yet.

Having regard to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Ekchari P.S. Case No.21/13, the petitioner no.2, Chhotelal Mandal, shall be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under sub- section(2) of Section 438 of the Code of Criminal Procedure.
