Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Son of the informant was found hanging in an abandoned house of the petitioner. The Doctor has found a case of hanging while performing post mortem examination. The petitioner and seven others are under suspicion to have committed the murder for the reason that the deceased had some affairs with the daughter of the petitioner and petitioner had threatened a day before the occurrence to kill the deceased.
Submission of the learned counsel for the
Patna High Court Cr.Misc. No.20657 of 2018 (2) dt.17-04-2018 2/2 petitioner is that other seven persons have been allowed anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 48315 of 2017 and Cr. Misc. No. 54056 of 2017. The investigation of the case is already complete and only suspicion is there against the petitioner.
Learned counsel for the informant opposed the prayer for bail on the basis of aforesaid material. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pranpur (Roshna) Police Station Case No. 116 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
