JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-09-2021 Heard Mr. Krishana Prasad Singh, learned senior counsel assisted by Mr. Shrawan Kumar Singh for the petitioner, learned counsel for the informant and learned APP for the State through virtual Court proceedings.
The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 504 & 34 of the Indian Penal Code and Section 27 of the Arms Act.
The main allegation against the petitioner is that he is the order giver.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case as he is father of the main accused. No specific overt act has been alleged in the F.I.R. against the petitioner. There is no allegation of firing against the petitioner. The allegation of firing is agaisnt
Patna High Court CR. MISC. No.24583 of 2021(2) dt.08-09-2021 2/2 Ashok Singh and Anoop Singh. No incriminating article has been recovered from his conscious physical possession. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Although there is one criminal antecedent against the petitioner but it arises out of the same incident. The petitioner has been languishing in custody since 13.12.2020.
Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Charpokhri P.S.
