2. Petitioner apprehends arrest in a case registered for the offence punishable under section 274 and 275 of B. N S and Section 30 (a) of Bihar Prohibition and Excise (Amendment ) Act 2022 .
3 . It is alleged that 24 liters of Nepali country made liquor was recovered from an open place .
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of confessional statement of Chaukidar. The alleged recovery of illicit liquor has been made from open place . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid

6. Considering the facts of the case, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Excise special Judge Excise Court No. 03 East Champaran at Motihari in connection with Patahi Police Station Case No. 321 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
