Petitioners seek bail in connection with Mahua P.S. Case No. 278 of 2016 registered under Sections- 20, 21 and 22 of the NDPS Act.
Learned counsel for the petitioners submits that nothing has been recovered from the conscious possession of the petitioners. The alleged recovery has been made in front of bridge near the brick kiln of one Jai Kumar Rai. Required procedure of law was not followed while making recovery. Petitioners have no criminal antecedent and are in custody since 24.07.2016.
Patna High Court Cr.Misc. No.10080 of 2017 (5) dt.05-07-2017 Considering the facts and circumstances of the case, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Vaishali at Hajipur in connection with Mahua P.S. Case No. 278 of 2016.
