JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-04-2022 The present petition has been filed for modifying the order dated 06.11.2020 passed in Cr. Misc. No. 14650 of 2020 to the effect that the time granted to the petitioner to surrender before the learned court below in order to avail the privilege of bail be extended by a further period of four weeks from today.

The learned counsel for the petitioner has submitted that the petitioner had gone to Gujarat for his livelihood, where he fell ill and then there was an outbreak of Covid-19 pandemic, resulting in the petitioner not being able to surrender within the

Thus, it is submitted that a sympathetic view be taken and the time granted to the petitioner to surrender before the learned court below in order to avail the privilege of bail be extended by a further period of four weeks.

Having regard to the facts and circumstances of the case and considering the submissions/ averments made in the present petition, I deem it fit and proper to grant further four weeks' time to the petitioner to surrender before the learned court of A.C.J.M.-1, Jhanjharpur in connection with Jhanjharpur (Arariya Sangram O.P.) P.S. Case No. 242 of 2019 corresponding to G.R. No. 1761 of 2019 for the purposes of availing the privilege of bail. The order dated 06.11.2020 passed in Cr. Misc. No. 14650 of 2020 stands modified to the aforesaid extent. The rest of the order dated 06.11.2020 shall remain as such. The petition stands disposed of.
