2. The petitioner seeks bail in connection with Rajgir P.S. Case No. 573 of 2024 instituted for the offences under Sections 316(2), 319(2), 318(4), 303(2), 336(2), 338, 336(3) and 61 of the B.N.S. Act and Sections 66 (C) and 66(D) of the I.T Act.

3. As per the prosecution case, a raid was conducted wherein seven persons were apprehended and certain recoveries of mobile and SIM cards were made. As far as this petitioner is concerned, a mobile of Vivo company was recovered against which it has been stated in the FIR that a complaint was lodged on 31.01.2024.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.13445 of 2025(2) dt.19-03-2025 2/2 that the petitioner has been falsely implicated in this case. From perusal of the FIR it is not clear whether the petitioner had used the said phone to cheat any person nor there is anything in the FIR which would suggest that some complaint was made with regard to the petitioner being involved in demanding some money using the said mobile phone. The petitioner has got no criminal antecedent and is in custody since 21.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Taking the same into consideration and the fact that the petitioner is in custody since 21.12.2024, let the petitioner above named, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 573 of 2024.
