The learned counsel for the State is present. The petitioners have challenged the order 08.08.2014 passed by learned Judicial Magistrate, Purnea in Complaint Case No. 1306 of 2012 whereby cognizance has been taken against the petitioners under Sections 323 and 379 of the Indian Penal Code.

However, on going through the order impugned as well as the materials in the present petition, this Court is not inclined to interfere with the order of cognizance.

The petitioners would be at liberty to approach the Court below and seek discharge, if such petition has already not been filed and disposed off. If the case is running trial, the Trial Court shall conclude the proceedings as early as possible.

With the aforesaid observation, the petition stands disposed off.
