2. The petitioner is in custody in a case registered for the offence punishable under Sections 8, 20(b), ii(b) of the NDPS Act.
3. As per allegation in the FIR, total 2 kg of ganja was recovered from the conscious possession of co-accused Raunak Mishra @ Jaggu.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner and the alleged ganja was recovered from the co-accused Raunak Mishra @ Jaggu and the said co-
Patna High Court CR. MISC. No.15896 of 2025(3) dt.14-05-2025 2/2 accused has been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 21374 of 2025. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 17.12.2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid facts and circumstances as also the fact that similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 21374 of 2025, so I am inclined to grant regular bail to the petitioner.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge/Special Judge, East Champaran, Motihari in connection with Rail Sugauli P.S. Case No. 59 of 2024 arising out of NDPS G.R. Case No. 119 of 2024. (Ramesh Chand Malviya, J) Brajesh Kumar/- U T
