06-09-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Singheshwar P.S. Case No.67 of 2019, registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, on 18.03.2019, while the informant was taking tea in the shop of one Umesh Mahto, it is alleged that this petitioner alongwith other FIR named accused persons came there and started assaulting informant with different weapons, as a result of which, he sustained injury and thereafter all the accused persons fled away. It is further alleged that when the informant was writing complaint petition with the help of some friends, once again, the FIR named accused

No.24671 of 2021(3) dt.06-09-2021 2/2 persons came and this petitioner is alleged to have made indiscriminate firing upon the informant, however; it did not hit him, rather it hit one Monu Kumar Mandal on his neck, as a result of which, in course of treatment, he died. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. It is further submitted that petitioner is alleged to have fired 3-4 round shots, out of which, one hit Monu Kumar Mandal. The present case is outcome of dirty village politics. The injury report does not support the allegation, as alleged in the F.I.R. and petitioner is in custody since 19.12.2020. Investigation is complete. However, considering the nature of allegation against the petitioner and the fact that as many as three persons have been injured in the occurrence, as per injury report annexed with the case diary, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
