Petitioner, already in custody, seeks bail in Majorganj PS Case No. 393 of 2017 registered under Sections 272 and 273 of the IPC and Section 30(A) of the Bihar Prohibition and Excise Act. The allegation in brief is that Mahesh Paswan and Arun Paswan were apprehended carrying 141 litres of Nepali liquor and some others escaped away.

Submission is that except disclosure of the name of the petitioner by the two apprehended accused stating their involvement also there is no other material, petitioner has no criminal antecedent and is in custody since 3.12.2017.

Having considered the said facts and circumstances, the petitioner Bigan Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge II Sitamarhi in connection with Majorganj PS Case No. 393 of 2017.
