JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-09-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Gamhariya P.S. Case No. 190 of 2019, registered under Section 392 of the Indian Penal Code.
The accusation is of coming of four miscreants boarding on motorcycle at Yash Krish H.P. Gas Agency, Gamhariya and snatching of Rs. 4100/- cash on the point of pistol, while at that time informant Sunil Kumar, being staff was present there. The informant has detailed the physique of the culprits.
Learned counsel appearing for the petitioner submits that petitioner is not named in the F.I.R. Further submission is that while petitioner was moving on motorcycle

No.13467 of 2020(4) dt.02-09-2020 2/2 belonging to one Nitish Kumar, but he was apprehended by the Police and inquiry was made about ownership of the motorcycle on which petitioner replied that this motorcycle is belongs to Nitish Kumar in spite of that petitioner was apprehended by the Police and got recorded his confessional statement showing his involvement in the present case. Further submission is that petitioner is in custody since 30.12.2019, but he has not been put on T.I.P., while informant has detailed the physique of the culprits.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Smt. Surbhi Srivastava, J.M. 1st Class, Madhepura in connection with Gamhariya P.S. Case No. 190 of 2019.
