Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

The petitioner is alleged to have assaulted with

Patna High Court CR. MISC. No.25201 of 2021(3) dt.09-02-2022 2/3 axe on the head of the informant and snatched gold chain.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. There was some dispute with regard to money transaction between the husband of the informant and the petitioner, hence, in order to grab the money, this false case has been lodged against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the fact that there is direct allegation against the petitioner to have assaulted with axe on the head of the informant, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.

The petitioner is directed to surrender before learned Court below within a period of four weeks from today and pray for regular bail which may be considered

Patna High Court CR. MISC. No.25201 of 2021(3) dt.09-02-2022 3/3 by the learned Court below without being prejudiced by the order of this Court.

With the aforesaid observation/direction the petition stands disposed off.
