The petitioner seeks bail in G.O.Case No.64 of 2019 / P.R.No.10 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The allegation is of recovery of 44.22 litres illicit foreign liquor kept in sacks from his courtyard. It has been submitted on behalf of the petitioner that the recovery has not been affected from the conscious possession of the petitioner. He has been falsely implicated in this case due to village politics. He is in custody since 17.01.2019. Petitioner has got no criminal antecedent. Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on
Patna High Court CR. MISC. No.14251 of 2019(2) dt.14-03-2019 2/2 bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Darbhanga, in G.O.Case No.64/19 P.R. No.10 of 2019 subject to the conditions that (i) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned. (ii) petitioner/s shall co-operate in the trial and shall be represented on each and every date fixed by the court. (iii) if the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner/s.
