====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-05-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 143, 353, 224 and 225 of the Indian Penal Code and Sections 30(a), 32(i) (ii), 41(i)(iii) of the Excise Act. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are women.

The informant alleges that liquor was seized from

Patna High Court CR. MISC. No.17362 of 2023(2) dt.10-05-2023 2/3 the shop of one Sochit Sada, further while the police was taking Sochit along with liquor in a jeep, when a mob of 5060 persons came and forcibly took Sochit and liquor away from the police custody.

Learned counsel for the petitioners submits that the petitioners were not apprehended from the spot as such nothing was recovered from their conscious possession, it is next submitted that the petitioners came to be implicated based on disclosure made by the Chowkidar with whom the husband of the petitioner is on an inimical term, it is also submitted at the cost of repetition that the petitioners are women and are persons with clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 500/- (Rupees Five Hundred) each with two sureties of the like amount each to the satisfaction of the learned trial court
