The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioner and others are alleged to have assaulted the informant and others. It is submitted that there is case and counter-case. The occurrence took place due to land dispute. The informant got grievous injury on his hand. It appears from the order of the learned Sessions Judge itself that the prayer for anticipatory bail of other accused has already been allowed and the anticipatory bail of the petitioner was rejected on the ground that it was the petitioner who firstly assaulted the informant. On perusal of the F.I.R. itself, it appears that on the order of the petitioner, he along with others assaulted the informant. Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.16947 of 2015 (2) dt.15-05-2015 2/2 enlarge the petitioner on anticipatory bail in Kudra P.S. Case No. 32/2015. Accordingly, the same is rejected.
