In this case, the petitioner is seeking anticipatory bail in connection with Forbesganj (Simraha) P.S. Case No.977 of 2018 corresponding to Special Case no. 1647 of 2018, registered for the offence punishable under Sections 30 (A) & 30(I) of Bihar Prohibition & Excise Act.

The police on information has raided the tea shop of the petitioner and recovered about 5 liters of Codeine Phosphate Cough Syrup, however, learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The petitioner has no criminal antecedent.

No.16264 of 2019(2) dt.15-03-2019 2/2 Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-Cum-Special Judge, Araria, in connection with Forbesganj (Simraha) P.S. Case No.977 of 2018 corresponding to Special Case no. 1647 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
