The petitioner seeks pre-arrest bail in connection with Saraiya P.S. Case No. 340 of 2015 registered under Section 47A of the Excise Act.

Regard being had to the recovery of 20 bottles of spirit and certain quantity of illicit liquor from the maize field of the petitioner, I am not inclined to grant pre-arrest bail to the petitioner. Accordingly, the application for pre-arrest bail is rejected.

However, if the petitioner surrenders and seeks bail, the same shall be considered on its own merit, without being prejudiced in any manner by the present order. (Ashwani Kumar Singh, J) Pradeep/- U T
