The petitioner apprehends his arrest in connection with Patliputra P.S. Case No. 116 of 2018 registered under Sections 302, 304B, 306, 406, 420, 120B and 34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He is innocent and has falsely been implicated in the present case due to oblique reason. Petitioner is husband of the deceased. The present case is lodged after lapse of six days of the alleged occurrence. Further submission is that on perusal of Viscera Report, it appears that the Doctor has not found any poison, as evident from Annexure-2 to the bail application. It is also

Patna High Court CR. MISC. No.14268 of 2019(7) dt.23-05-2019 2/2 submitted that the deceased herself has taken medicine and thereafter, the petitioner has admitted her in Hospital and during treatment she died. The information of death has been given to the complainant and his family members.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-XII, Danapur in connection with Patliputra P.S.
