The petitioner seeks regular bail in Samastipur (Muffassil) P.S. Case No.253 of 2016 registered for the offence under Section 379 of the Indian Penal Code.

Allegation against the petitioner is of carrying of stolen motor cycle and it also appears that he is involved in two criminal cases also.

Submission of the learned counsel for the petitioner is that there is no recovery from the possession of the petitioner and so far other cases are concerned, in which he has already been granted bail and he is in custody for three months. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.35192 of 2017 (2) dt.04-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner.

However, he may renew his prayer for bail after framing of charge in this case.

The petition is dismissed.
