JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 12.07.2017 seeks bail in connection with Shikarpur P.S.Case No. 274 of 2017 registered under Sections 302, 307, 323, 324, 325, 341 and 504/34 of the Indian penal Code.
Allegation in brief is that petitioner stabbed in the abdomen of the victim followed by stab injury of the informant's brother and another accused just below the neck.
Submission is that FIR is instituted after delay of 08 days, so there is no corresponding injury on the deceased attributed to the petitioner and deceased was taken to Paras Hospital by the family members but due to advise of the doctor, he was taken away from there and lack of proper medical treatment, he expired and the cause of death is due to only kidney injury and meningitis.
Patna High Court Cr.Misc. No.6569 of 2018 (3) dt.03-04-2018 2/2 Whereas learned counsel for the State submits that postmortem report shows that there is stab injury also and earlier deceased was examined by the doctor and stab wound was found in the abdomen and intestinal loop coming out from abdomen. Having considered the aforesaid facts and circumstances and specific allegation against the petitioner, the prayer of bail is rejected.
