JUSTICE ARUN KUMAR ORAL ORDER 01-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Mahila P.S.Case No. 32 of 2017 registered under Sections 376 and 323 of the Indian penal Code.
Allegation in brief is that prosecutrix was living separately from husband for one and half years, she is a school teacher and petitioner being Incharge Headmaster, used to visit her residence and sexually exploiting her for last six months, for which started making protest then he started committing rape. Learned counsel for the petitioner submits that prosecutrix is a married lady living separately with her husband and allegation itself discloses consensual relationship.
However, learned counsel for the informant submits that petitioner used to commit rape to his subordinate, so it's a case of
Patna High Court Cr.Misc. No.4217 of 2018 (2) dt.01-02-2018 2/2 serious offence.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Jayant Kumar Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned SDJM, Aurangabad in connection with Mahila P.S. Case No. 32 of 2017.
