This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Ujiyarpur PS Case No. 8 of 2016 for the alleged offence punishable under Section 341/386/307/34 of the Indian Penal Code and Section 3/ 4 of the Explosive Substance Act. Learned counsel for the petitioner would submit that earlier the petitioner approached this Court for grant of regular bail in Cr. Misc. No. 56919 of 2017 which was rejected on 25.01.2018. The Court while rejecting the application for bail directed the court below to expedite the trial and preferably conclude the same within one year. Despite the aforesaid
Patna High Court CR. MISC. No.13724 of 2019(2) dt.06-03-2019 2/2 direction, the trial has not yet been concluded and in view of the liberty granted by the Court by order dated 25.01.2018, petitioner has filed the present application. Considering the fact that petitioner has remained in custody since 18.07.2017, the Court is inclined to release the petitioner on bail. This application is allowed. Accordingly, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S D J M, Dalsingsarai, Samastipur in connection with Ujiyarpur PS Case No. 8 of 2016.
