2. Petitioner seeks regular bail in connection with Kanti P. S. Case No. 549/2024 in a case registered for the offences punishable under Sections 103, 61(2), 3(5) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per the prosecution case, informant alleges that on 14.10.2024 at about 4:30 PM, while her father was returning home from Kanti, in the meantime, he was shot by 4-5 unknown miscreants near Deohan Siwan. Informant suspects that Jayprakash Singh and others, conspired and committed the alleged offence over a property dispute involving 3 acres of land which was gifted to her father.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.14257 of 2025(6) dt.11-07-2025 2/2 petitioner is not named in the F.I.R., his name transpired during course of investigation. Petitioner is in custody since 28.11.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application. He submits that during investigation, one golden Revolver, two cartridges and one empty cartridge have been recovered from the rented accommodation of the petitioner. The postmortem report reveals that the deceased was shot dead. It has come during investigation that this petitioner shot dead Radhe Singh after obtaining a contract from one Jai Prakash Singh. The petitioner has got two criminal antecedents.
