2. The petitioner is in custody in connection with Durgawati P.S. Case No. 263 of 2023 for the offence punishable under sections 304B and 34 of the Indian Penal Code lodged on 07.08.2023 by the informant, Upendra Bind.

3. The informant alleged that the marriage of his sister had taken place with the petitioner but was tortured for dowry and on 06.08.2023, the information came that she has committed suicide, they went to the in-law's house and found the body to be on the road and there was crowd around it, being convinced that she has been killed, the FIR.

4. Though learned counsel for the petitioner tried to impress upon this Court that it was actually a suicide due to

No.15812 of 2024(4) dt.30-08-2024 2/2 some dispute with the husband, learned APP has taken this Court to the Post-Mortem Report which was called for and the reason of death has been recorded as asphyxia, due to strangulation. Learned APP submits that it cannot be a case of suicide rather the lady has been killed.

5. Considering the report that has come in the PostMortem, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
