The petitioner seeks regular bail in connection with Belaganj P.S. Case No. 52 of 2016 for the offences punishable under Sections 323, 324 and 302/34 of the Indian Penal Code. The allegation is regarding the petitioner and one other co-accused person, namely, Kamlesh Paswan having arrived at the house of the informant and thereafter, quarrel had taken place and the co-accused Kamlesh Paswan had assaulted the father of the informant on his head by means of lathi, resulting in him sustaining injury on account of which he died subsequently. The said co-accused Kamlesh Paswan is also said to have assaulted the grand daughter of the informant. The learned counsel for the petitioner submits that as

No.16148 of 2019(2) dt.29-03-2019 2/2 far as the petitioner is concerned, no allegation has been levelled against him of assaulting any members of the prosecution party, hence, he should be granted the privilege of bail. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 1.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 52 of 2016.
