JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-06-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State through video conferencing. The petitioners apprehend their arrest in connection with Kudhani (Kurhani) (Turki O.P) P.S. Case no. 587 of 2019, registered under Sections 304(B) and 120(B)/34 of the Indian Penal Code.
The accusation is of killing of sister of informant by her husband and other in-laws due to non-fulfillment of demand of dowry, while she was blessed with a male issue, aged about four years, and a female issue, aged about two and half years.
Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.12744 of 2020(2) dt.30-06-2020 2/2 both the petitioners are married Nanad and Nandoshi of the deceased Priyanka, sister of the informant Manohar Sah, and they have falsely been implicated in this case. Further submission is that Rakesh Kumar Gupta, husband of deceased, is in custody. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.MIII (West), Muzaffarpur in connection with Kudhani (Kurhani) (Turki O.P) P.S. Case no. 587 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
