JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 111 of 2016, registered under Section 377 of the Indian Penal Code and Section 8 of the POCSO Act. Learned counsel for the petitioner submits that the prayer for bail of the petitioner has been rejected on 31.01.2017 vide Criminal Miscellaneous No. 152 of 2017 for the present. Further submission is that petitioner is in custody since 03.05.2016 and charge has been framed on 16.03.2017, but no witness has been examined.

Having regard to the facts and the circumstances of the case and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.36022 of 2017 (2) dt.04-10-2017 2/2 Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-I, Bhojpur at Ara in connection with POCSO Case No. 17 of 2016 arising out of Jagdishpur P.S. Case No. 111 of 2016.
